Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LUMREN application and website (the "Service"), operated by LUMREN ("we," "us," or "our"). By downloading, accessing, or using LUMREN, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use LUMREN. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have parental or guardian consent to use the Service. We reserve the right to terminate accounts found to be held by users under 13.

2. Account and Access

LUMREN does not currently require account creation for core functionality. App state is stored locally on your device. Where cloud features (scan backup, cross-device sync) are used, you agree to provide accurate information and maintain the security of your device.

You are responsible for all activity that occurs through your use of the Service on your device.

3. Permitted Use

You may use LUMREN for your own personal, non-commercial wellness purposes. You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated tools to access or scrape the Service
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to harass, abuse, or harm others
• Resell, sublicense, or commercially exploit any part of the Service

4. Health and Medical Disclaimer

LUMREN provides biometric estimates and wellness guidance for informational and personal development purposes only. Specifically:

• Heart rate, HRV, SpO₂, and other measurements provided by LUMREN are estimates derived from smartphone camera optical sensing. They are not medical-grade measurements and should not be used for medical diagnosis or treatment decisions.
• AI companion responses are generated by artificial intelligence and are not a substitute for professional mental health, medical, or therapeutic advice.
• Breathwork, mudra, and sound therapy content is intended as general wellness practice. Individuals with cardiovascular conditions, respiratory conditions, epilepsy, or other health conditions should consult a physician before use.
• The "dimensional level" and consciousness metrics are conceptual wellness frameworks, not scientific or medical classifications.

If you are experiencing a mental health crisis or medical emergency, please contact emergency services or a qualified professional immediately.

5. Intellectual Property

The Service, including all content, features, code, design, trademarks, and branding, is owned by LUMREN and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app on your personal device for personal use.

You retain ownership of any personal content you create (journal entries, voice notes). By submitting content to the Service, you grant us a limited licence to process and display that content to provide the Service to you.

6. Third-Party Services

LUMREN integrates third-party services including AI providers (Anthropic), voice synthesis (ElevenLabs), and cloud infrastructure (Supabase). Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

7. Subscription and Payments

LUMREN offers a free 3-day trial and paid subscription plans. Current pricing:

• CORE: $14.99/month or $89.99/year
• PRO: $29.99/month or $169.99/year

AUTO-RENEWAL DISCLOSURE: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store or Google Play account settings. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Additional terms:

• Subscriptions are billed through the Apple App Store or Google Play Store
• Cancellations must be made through your device's subscription management settings
• Refunds are governed by Apple's and Google's respective refund policies
• We reserve the right to modify pricing with reasonable advance notice

7a. Digital Reset Feature

The Digital Reset feature is an optional wellness tool that adds a 68-second reset experience before blocked apps open. By enabling Digital Reset, you agree to the following:

• You voluntarily choose which apps to block. LUMREN does not select, suggest, or require blocking of any specific apps.
• The feature is for personal wellness and attention management purposes only. It is not a parental control system and should not be used to restrict another person's device access without their consent.
• The feature uses Apple's Family Controls framework. Once enabled, Family Controls authorization is managed by Apple and may require device owner approval to disable.
• LUMREN is not responsible for any consequences arising from app blocking, including missed notifications, communications, or time-sensitive information while an app is blocked.
• Digital Reset is a wellness aid and is not a substitute for professional advice regarding screen time, digital addiction, or mental health.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMREN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless LUMREN and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which LUMREN is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction therein.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service.
